Are After Market Parts Covered if Not at Fault?

Title: Are Aftermarket Parts Covered if I’m Not at Fault?

Hi r/insurance,

I recently got into an auto accident in Texas, where the other party accepted fault after hitting me while I was stopped at a stop sign. Unfortunately, the paint protection film (PPF) on my vehicle got damaged and needs to be replaced, with estimates around $3,000.

My insurance policy only covers $1,000 for aftermarket parts, and since the other party is liable, shouldn’t they be responsible for restoring my car to its pre-accident condition, including the PPF?

The other party’s insurance claims that I will need to pay out of pocket for the difference, but it seems unfair for me to bear any costs when the accident wasn’t my fault. Is there legal precedent I can reference in discussions with them?

Thanks for your help!

  1. Hi there!

I’m sorry to hear about your situation; dealing with the aftermath of an accident can be really frustrating. In Texas, if the other party is found liable for the accident, their insurance should ideally cover all your damages, including any aftermarket parts like your paint protection film. Since the other party has accepted liability, you have the right to seek compensation for the full cost to repair your vehicle to its pre-collision condition.

It’s important to keep in mind that insurance companies may sometimes push back against covering aftermarket parts. However, you can certainly argue that the paint protection film is part of your vehicle’s value and should be included in the repairs. It might help to collect documentation, such as receipts or installation records for the PPF, to strengthen your case.

If the other party’s insurance is still refusing to cover the full cost, you might consider:

    1. Requesting a Detailed Explanation: Ask them to provide a written rationale for why they believe the aftermarket part is not covered.

    2. Negotiation: Sometimes, having a conversation with a claims adjuster can lead to a more favorable outcome. Be sure to present your case clearly and confidently.

    3. Legal Advice: If negotiations stall, consulting an attorney who specializes in auto insurance claims could be beneficial. They might provide legal precedent or help advocate on your behalf.

    4. Filing a Complaint: If you feel you’re being unfairly treated, you can file a complaint with the Texas Department of Insurance.

Document everything and stay persistent! Best of luck, and I hope you get the repair costs covered soon.
