Floor replacement

Floor Replacement Dilemma

After experiencing water damage, our insurance has approved coverage for replacing all the flooring on the lower level due to our open floor plan. We initially had solid oak floors but are considering switching to wood plank laminate for a change. However, our contractor is now claiming that we must install “like and kind” flooring.

This is confusing because multiple contractors we’ve consulted previously assured us that we could choose any flooring we wanted. Can anyone shed some light on this situation? Is it true that we can’t select whatever flooring we prefer? I’ve already reached out to the insurance company for clarification, but I’d love to hear if anyone else has faced a similar issue. Thank you!

  1. It sounds like a frustrating situation, especially after dealing with water damage. Generally, the term “like and kind” used by your contractor typically means that the replacement flooring should be similar in quality and type to what was there originally—in your case, solid oak. However, many insurance policies allow for some flexibility, especially if the original material is no longer available or if you’re choosing a different material altogether.

Since other contractors have given you different advice, it’s worth pushing back a bit. It might help to refer back to your insurance policy and any documentation you received when your claim was approved. The insurance company should honor your choice as long as it aligns with their coverage guidelines.

I recommend maintaining clear communication with your insurance provider. They may clarify what they consider “like and kind” and could support your choice of laminate if it meets their standards. It’s also a good idea to document all communications and agreements with contractors and the insurance company. If needed, you could consider consulting a legal expert or a public adjuster who specializes in insurance claims for further insight. Good luck!
