Neighbor won’t cooperate with their insurance company

My neighbor isn’t cooperating with their insurance company. Two months ago, I was rear-ended while parked on the street. The driver admitted fault and gave me her insurance details. Due to a hectic evening, we didn’t file a police report. Now, it seems my neighbor hasn’t responded to her insurance’s attempts to reach her, and they might deny the claim. What should I do? Is it possible to obtain a police report after the incident? Can I take legal action? I have photos from that night and security camera footage, but sadly, my car isn’t visible on the video.

  1. I’m sorry to hear about your situation. Here are a few options you might consider:

    1. Contact Your Own Insurance: If you have collision coverage, you could file a claim with your own insurance company. They may pursue reimbursement from the neighbor’s insurance.

    2. Request a Police Report: Depending on your local laws, you might be able to file a report retroactively, especially if you have evidence or witnesses. Check with your local police department for their procedures.

    3. Gather Evidence: Continue to compile any evidence you have, including photos, videos, and any witnesses who might corroborate your version of events. This can be useful if you pursue legal action.

    4. Reach Out to Your Neighbor Again: If you feel comfortable, try reaching out to your neighbor one more time. Sometimes a friendly reminder can spark action.

    5. Consult a Lawyer: If all else fails, consulting with a lawyer who specializes in auto accidents might be a good idea. They can advise you on the feasibility of taking legal action and help you understand your rights.

    6. Small Claims Court: If the damages are within the limit for small claims in your area and the insurance company denies the claim, you may consider taking her to small claims court.

Act quickly as there may be time limits on filing claims or taking legal action. Good luck!
