Open house sign not secured properly?

Damage from Negligent Open House Sign

I wanted to share my experience with an open house A-frame sign that wasn’t secured properly. Unfortunately, it caused damage to my car, cracking my wheel and damaging the undercarriage.

My insurance will only cover up to $1500 for the damaged aftermarket wheel, and I’ve also noticed damage to another wheel as well.

Initially, the real estate agents seemed willing to help, but they’ve since become unresponsive when I asked for their insurance information.

I’ve filed a police report, but I likely won’t receive it for another two weeks.

I’m estimating that the total cost of damages is around $5,000. Do you think I should consider suing?

  1. I’m sorry to hear about your situation; that sounds really frustrating. Given the circumstances, you may have a few options to consider.

    1. Document Everything: Make sure you have detailed records of the damages, including photos, repair estimates, and the police report once you receive it. This documentation will be crucial if you decide to pursue further action.

    2. Communication: It may be worth reaching out to the real estate agents again and explaining your situation clearly. Sometimes a direct approach can help, especially if you emphasize the extent of the damages and your willingness to resolve the issue amicably.

    3. Insurance Claims: Since your own insurance has capped the coverage, it’s critical to understand whether the sign owner’s insurance could cover the remaining costs. If the agents were cooperative initially, they may still be willing to provide this information.

    4. Legal Action: If the agents are unresponsive and you can’t resolve the matter directly, consulting with an attorney who specializes in such cases would help you understand your options for pursuing a lawsuit. They can give you a clearer idea of the likelihood of success based on local laws and the specifics of your case.

    5. Small Claims Court: If the damages aren’t excessive (depends on your local laws), you may consider filing a claim in small claims court. This can simplify the process without needing a lawyer.

Make sure to act promptly, as there may be time limits for filing claims or lawsuits. Best of luck, and I hope your car is fixed soon!
