Got rear ended by semi truck

Update on My Accident

I was rear-ended by a semi-truck on October 17th, and the state police determined the truck driver was at fault. The impact caused me to hit two other cars—a white BMW and the corner of a truck—before I rolled into the median. Almost immediately, I developed a severe headache. After exchanging information and involving the police, I went to the hospital, where I was diagnosed with a mild concussion.

The following day, I visited my primary care doctor, who recommended that I take it easy for two weeks while my concussion symptoms resolved. However, after two weeks, I was still experiencing symptoms, so she advised me to continue with light duty for another week. Once I was cleared three weeks post-accident, I began to notice lower back pain, prompting me to seek massage and chiropractic therapy.

By November 15th, I was keeping up with my therapy and was feeling better. However, when I started a full-time job at the beginning of the year, I struggled to maintain my chiropractic visits and ended up stopping for about a month to a month and a half. February was particularly tough as I dealt with the flu and then pneumonia, which kept me out of work for about three weeks.

Now, I’m looking to get back into therapy but am concerned about how the break in treatment might affect my case when it comes time for settlement. I’m considering hiring a lawyer and would appreciate any advice on how to proceed.

  1. I’m really sorry to hear about your accident and the challenges you’ve faced since then. It sounds like you’ve been through a lot. Regarding your concerns about missing therapy sessions, it’s quite common for insurance companies to scrutinize the continuity of care when evaluating a claim. Having documentation of your treatments, symptoms, and any breaks in therapy can be crucial. While missing sessions might complicate things, it’s important to prioritize your health first.

    Here’s what you can do:

    1. Keep Detailed Records: Maintain a record of all your medical visits, treatments, symptoms, and any correspondence related to the accident. This can be helpful for your lawyer.

    2. Follow Medical Advice: If your doctor recommends continuing therapy, try to make it a priority as much as possible. Even if you have missed some sessions, going back and documenting your progress can be beneficial.

    3. Consult a Lawyer: Finding a lawyer who specializes in personal injury accidents can help you navigate this process. They can provide guidance specific to your situation and help you understand how the missed therapy might impact your case.

    4. Communicate with Your Healthcare Providers: Let your doctors and therapists know about your situation and that you want to continue care. They may be able to adjust your treatment plan to fit your current lifestyle and needs.

    5. Stay Persistent: Don’t get discouraged. Focus on healing and getting back into a routine with therapy. It’s important for your health and your case.

Wishing you a smooth recovery and the best of luck with your claim. You’re doing the right thing by seeking help and looking out for your well-being!
