Hit and Run Incident
I was involved in a hit and run on the highway. Some reckless driver sideswiped my car and then sped off. I managed to get off the highway and onto the same street, where I pulled over to assess the damage. The driver had scratched my car pretty badly and broken my side mirror. As I was getting out to take photos of the damages and his license plate, he unexpectedly hit me again while I was outside my car, causing even more damage by breaking my driver door and fender, rendering the door unusable.
I tried to call the police for help, but I had to hold my door open while also steering my car, which made it difficult. I attempted to follow him from behind to get a better look at his plate number, but as we turned onto another street, he intentionally brake-checked and crashed into me again. This was unbelievable and has left my car, which I rely on for work, completely totaled. It turns out he’s only a year younger than me.
Although no police report was filed, I did file claims with my insurance company. However, I suspect he and his insurance are not being truthful about the events. I noted that he was driving aggressively, speeding off the highway ramp, damaging my driver side, and even triggering my airbags. Sadly, I only have liability insurance for my vehicle.
What options do I have for taking legal action against this person, considering I don’t have serious injuries? I did mention I was hurt, and he probably reported injuries as well, despite appearing unscathed when he got out of the car. I recorded everything on my phone after the incident, but my injuries are minor—just bruises and visible scars. I drive commercial trucks, and it would be devastating if this incident jeopardizes my career due to some irresponsible driver who thinks it’s okay to play bumper cars. What should I do?
I’m really sorry to hear about your experience. It sounds incredibly frustrating and stressful. Here are some steps you can consider taking in this situation:
Document Everything: Since you recorded the incident on your phone, make sure to save that footage and any pictures you took of the damages. Collect all related information, including witness statements, if you have any.
Consult with a Lawyer: Given the circumstances and the aggressive behavior of the other driver, it’s wise to consult with a personal injury attorney. They can help you understand your options regarding civil lawsuits and the viability of your case, especially since you don’t have full coverage.
File a Claim with Your Insurance: You mentioned you have liability insurance, but it’s essential to inform your insurance company about the accident as soon as possible. They might guide you on how to proceed, especially if you need to claim against the other party.
Consider a Police Report: Although a police report was not filed at the time of the accident, try to contact the local police department. They might still be able to document the incident based on your evidence.
Seek Medical Attention: If you’re experiencing any discomfort or pain, it’s important to get medical attention. Having medical documentation of any injuries can also support your case should you choose to pursue compensation.
Look Into Legal Action: If the other driver’s actions can be proved as reckless or intentional (like the brake-checking), you might have grounds to file a civil suit for damages, even if you don’t have serious injuries.
Keep All Communication Professional: When communicating with your insurance and the other driver (if applicable), stay calm and professional. Avoid any confrontational language.
Consider Your Future Needs: Since your vehicle is essential for your work, discuss rental reimbursements with your insurance. They might cover a rental while your car is being repaired or until the claim is settled.
Reach Out to Local Authorities: If the driver was under the influence, report this to the relevant local authorities as they may take further action.
Your safety and well-being are the most important things, so take care of yourself first. Hopefully, you’ll be able to navigate this situation and get the compensation you deserve to support your career!
