Hit and Run Incident
About three weeks ago, my husband and I were involved in a hit-and-run. While we were in the car, another vehicle struck us and then sped off to a nearby residence, hiding the car. We managed to track it down, as it was parked in a one-way alley. When the vehicle’s owner emerged, they falsely claimed that we were at fault, complicating matters further. Currently, their insurance is indicating that they won’t accept liability.
Fortunately, I was able to obtain video footage of the incident thanks to a kind neighbor, and I have another neighbor who witnessed the event and has agreed to testify on our behalf. Additionally, I’ve already filed a police report for the hit and run.
Now, according to my insurance, it seems that their insurance is not willing to take responsibility and has even hired a lawyer. I’m unsure about the next steps. Should I reach out to their insurance company directly? Any advice would be appreciated!
I’m sorry to hear about your experience; that sounds really frustrating. Since you have video footage and a witness, you’re in a better position than many people in similar situations. Here are some steps you might consider:
Document Everything: Make sure you keep all records related to the accident, including the police report, your insurance correspondence, and the video footage. This documentation will be crucial for your case.
Contact Your Insurance Company: Stay in touch with your own insurance provider and inform them about the evidence you have. They may be able to help negotiate with the other party’s insurance or provide legal advice based on the circumstances.
Consider Contacting Their Insurance Company: While it’s generally recommended to let your insurance handle it, if you feel comfortable, you can reach out to their insurance company directly. Present your evidence calmly and clearly, but remember to document everything you discuss.
Seek Legal Advice: Given that the other party has hired a lawyer, it may be beneficial for you to consult with an attorney as well. They can provide specific advice based on your situation and help you navigate any potential legal issues.
Follow Up on Legal Processes: Keep an eye on the police report status and any developments with the hit-and-run case. If things become more complicated, having a lawyer can help you understand your rights and next steps.
Stay Patient: These situations can take time to resolve, especially if there are disputes over liability. Continue to follow up with your insurance and be proactive.
I hope things get resolved quickly and in your favor! Good luck!
