Insurer Shares Defendants’ Details with Victim
I submitted a request for an insurance claim against a nonprofit after their IT Vendor embezzled my paycheck. The insurer replied, stating they couldn’t disclose their client’s insurance information. However, they did share the names of the two employees they’re defending, along with the two professional liability insurance companies and two corporate fraud attorneys in the cc of their response. Is this standard practice, or did they accidentally include the thief and their team in the cc?
It sounds like a rather unusual situation. Typically, when an insurer is handling a claim involving a potential liability issue, they should maintain confidentiality regarding sensitive information. However, it’s not uncommon for them to informally include relevant parties, such as the defendants and their legal representatives, in the correspondence.
That said, if the insurer accidentally included those individuals in a CC (carbon copy) rather than a BCC (blind carbon copy), it could raise concerns about confidentiality and the handling of your claim. It might be beneficial for you to reach out to the insurer for clarification and express your concerns about privacy and the inclusion of individuals who are involved in the case. You may also consider seeking legal advice to ensure your rights are protected throughout this process.
