Mental Health Claim

Mental Health Claim Inquiry

Hello everyone,

I was recently involved in a minor car accident where I was sideswiped, resulting in estimated damages of around $5,000. As a service-connected veteran with a history of mental health challenges, I sought assistance from my provider immediately following the incident due to increased hyper-vigilance while driving—I now have a heightened fear of vehicles approaching from my left and right. The other party has already admitted fault in the accident.

Since then, I’ve missed some work to manage both the repairs and my anxiety related to being on the road. Is it possible for me to file a claim for the mental health distress I’ve experienced as a result of this incident?

Thank you for your guidance.

  1. I’m sorry to hear about your car accident and the distress you’re experiencing. Given your situation, it may be possible to file a compensation claim for the mental health impacts resulting from the accident. Since you are a service-connected veteran for mental health, documenting how the incident has exacerbated your existing conditions will be crucial.

Here are some steps you might consider:

    1. Gather Documentation: Collect all relevant documents, including accident reports, estimates for vehicle repairs, medical records from your mental health provider, and any documentation of missed work due to anxiety or related issues.

    2. Consult with Your Provider: Speak with your mental health provider about your experiences since the accident. A letter or report from them could support your claim, detailing how the accident has affected your mental health.

    3. Research Claim Options: Look into your rights and options for claiming compensation. Since the other party admitted fault, you may have a case for damages filed with their insurance. Additionally, check if there are specific provisions for veterans that could apply to your situation.

    4. Consult a Legal Expert: Speaking with a lawyer who specializes in personal injury or mental health claims can help clarify your options and improve your chances of a successful claim.

    5. File Your Claim: Follow the necessary procedures for submitting your claim to the appropriate insurance company or legal entity.

Your mental well-being is important, and seeking the support you need is a positive step. Best of luck with your recovery and the claims process.
