Question about Gap insurance

Question Regarding Gap Insurance

I have a question about my Gap insurance after an accident where I was at fault. I’ve also been incorrectly charged with driving while intoxicated. Although the court case concluded with just a violation—a “wet” reckless—I’m unsure what information I should provide to my Gap insurance company. My primary car insurance is with Progressive, while my Gap insurance is through Ally.

I don’t expect them to cover my $5,000 balance, but I think it’s worth a shot to try!

For context, I only tested positive for Adderall within its therapeutic range and had trace amounts of THC from smoking with a friend the night before. I’m really embarrassed to be in this situation. Any advice would be appreciated!

  1. It sounds like you’re going through a tough situation, and I can understand your concern about how this might impact your gap insurance claim. Here are some steps you can take to provide the necessary information to your gap insurance company, Ally:

    1. Document Everything: Gather all relevant documents related to the accident, including the police report, court documents regarding the charges, and any communications you’ve had with your car insurance company, Progressive.

    2. Contact Ally: Reach out to your gap insurance representative directly. Explain your situation clearly and provide them with all necessary details about the accident, including your liability and the subsequent legal outcomes.

    3. Provide Evidence: If you have documentation proving that you were charged with a violation (rather than a DUI) and that the wet reckless charge doesn’t imply severe impairment, include that information. Your medical records indicating your therapeutic use of Adderall could also be relevant.

    4. State Your Case: Clearly express your intention to claim the balance, even if you aren’t expecting a certain outcome. Explain why you believe you should be covered, emphasizing any mitigating circumstances.

    5. Follow-Up: Ensure you follow up on your claim regularly. Keeping open lines of communication can often help facilitate a smoother process.

    6. Consult an Attorney: If you’re unsure about how the legal aspects might affect your claim, consider consulting with an attorney who specializes in insurance or personal injury. They can provide guidance on your rights and obligations.

It’s understandable to feel embarrassed, but remember that accidents happen, and it’s important to focus on resolving the financial implications. Best of luck, and I hope you find a resolution to this situation!
