Trash Truck Broke My Gate – Part 2

Trash Truck Damaged My Gate – Part 2

The garbage truck driver damaged our gate, and the replacement will cost us $3,000 for parts and labor. We submitted a claim to the driver’s auto insurance, but it was denied because the truck isn’t covered for business use.

I reached out to the owner, who claims to have a business policy and said he would contact them. However, he also insists that the driver was just his friend and not an employee, suggesting that we should pursue the driver instead. That’s not how business liability works, obviously, and it seems like he may make this process more complicated.

The auto adjuster recommended that we file a claim with our homeowner’s insurance and let them handle the subrogation. My question is: will this claim affect my insurance record?

  1. I’m sorry to hear about the trouble you’re experiencing with the gate. It can be really frustrating when accidents like this happen, especially when the responsibility isn’t clear.

As for your question about filing a claim with your homeowners insurance, it generally shouldn’t have a significant impact on your premiums unless you’re making multiple claims or your insurer determines that your situation falls under a “high-risk” category. However, insurers do keep records of all claims, and they might consider this when determining rates in the future. It’s best to check with your insurance agent and ask about how this specific claim might affect your policy.

Also, since the trash truck was operating in the course of business, you might have a better shot at getting the damages covered through your homeowners policy followed by subrogation. Just ensure you have all the necessary documentation to support your claim. It sounds like you’re doing all the right things by exploring your options. Good luck!
