Adjuster hasn’t fixed or totaled my car it’s almost been 6 months

Six Months Without Resolution on My Stolen Car

Hi everyone, I’m reaching out for advice and support regarding a frustrating situation. Last year, my car was stolen right outside my house, and we’re approaching the six-month mark since it was taken. Unfortunately, my insurance adjuster has been unresponsive and unhelpful throughout this entire process.

Every time I try to contact him, he either doesn’t answer or doesn’t return my calls or emails. Whenever I do manage to get ahold of him, he simply says they are “investigating.” I’ve asked him what exactly they are investigating, especially since the highway patrol recovered my vehicle less than two weeks after the theft.

I contacted the highway patrol to clarify, and they informed me that there was no ongoing investigation regarding my car; it was a straightforward recovery. They picked it up and took it to a tow yard. Unfortunately, I couldn’t retrieve it myself since it’s about three hours away, so I signed a release form for my insurance to handle the pickup. I was under the impression that they would bring the car to my home, but it’s still sitting at the tow yard.

The tow yard assured me that they wouldn’t charge me since the insurance is responsible for repairs, and the person I spoke with said the car looks alright and hasn’t been in a crash. They suggested I find a trusted local shop to inspect it, but the adjuster keeps saying he’s either “investigating” or waiting for his supervisor. This has been the status quo for quite some time now.

I desperately need my car back, but the adjuster mentioned that I could pick it up but not drive it due to lack of gas. He also asked me for my call and text records, which I had already sent him. Unfortunately, I wasn’t able to provide them in the PDF format he requested. My phone carrier mentioned they could send the records to my insurance with a subpoena, but the adjuster seems hesitant to go through that process, stating it would take months.

It feels like I’m going in circles. The adjuster keeps coming back with requests for documents I’ve already submitted and claims he’s waiting for his supervisor. I’m starting to think that his handling of this case is inadequate, and I’m considering seeking legal help, though most lawyers I’ve contacted seem focused on accident or injury claims.

I just want my car back. Is this kind of delay normal? Any advice or support would be greatly appreciated!

  1. I’m really sorry to hear what you’re going through; that sounds incredibly frustrating. It’s definitely not normal for a claim to take this long, especially with your car being recovered swiftly. Here are a few steps you might consider:

    1. Document Everything: Keep a detailed record of all your communications with the adjuster, including dates, times, and the content of your conversations. This will be helpful if you need to escalate the situation.

    2. Contact a Supervisor or Manager: If the adjuster isn’t responding, try to escalate your issue to their supervisor or a manager at the insurance company. Sometimes, higher-ups can help expedite the process.

    3. File a Complaint: If you’re not getting any resolution, consider filing a formal complaint with your insurance company. Most companies have a process for this, and it may prompt them to act more quickly.

    4. Seek Help from the State Insurance Commissioner: If your insurance company is still unresponsive after escalating the issue, you can contact your state’s insurance commissioner. They regulate insurance companies and can sometimes intervene on your behalf.

    5. Consider Legal Advice: If you believe your claim is being mishandled, consult with a lawyer who specializes in insurance claims. They can better guide you on your rights and options, even if they primarily handle personal injury claims.

    6. Local Resources: Look for consumer protection agencies in your area that can provide guidance. They might have resources specifically for dealing with insurance issues.

You’re not alone in this, and many people have had to fight for fair treatment from their insurance companies. Stay persistent, and hopefully, you’ll get your car back soon!
