Auto claim part 2

Auto Claim Update – Part 2

A few weeks ago, I shared my experience with an insurance company that was only willing to assign 50% fault in an accident. They mentioned conflicting reports about the incident, but I know what really happened. I was driving straight in the left lane when their client made an illegal left turn from the middle lane and collided with me. The other driver claims I was in the left lane and crossed over the line, hitting him instead.

Is there any way to prove he’s not telling the truth based on the damage to our vehicles? My entire right side is scratched because I was going straight and he hit me with his bumper as he turned. Would it be possible to only damage his bumper while my whole right side was affected, given I was not crossing lanes? Any insights or advice would be appreciated!

  1. It sounds like a frustrating situation! When it comes to accidents and determining fault, evidence is key. Here are some steps you could take to strengthen your case:

    1. Photographic Evidence: If you have photos of the scene, they can provide valuable context. Pictures of the damaged areas on both vehicles can illustrate how the impact occurred.

    2. Damage Analysis: Consult with a professional auto body shop. They might be able to analyze the damage and provide an assessment of how the collision happened. If your damage is consistent with being struck while going straight, that’s important evidence.

    3. Witness Statements: If there were any witnesses to the accident, their statements could corroborate your version of events. Eyewitness accounts can be influential.

    4. Police Report: If a police report was filed, check if it reflects your account of the accident. While it may not be definitive, it can provide an objective perspective.

    5. Traffic Cam Footage: If the accident occurred near a traffic camera, check if any footage is available. This could be the best evidence to show the sequence of events.

    6. Traffic Laws: Look into local traffic laws regarding the left turn from a middle lane. If the other driver was indeed making an illegal turn, that could help establish fault.

    7. Consult with Your Insurance: It may also help to discuss this with your insurance adjuster. They can provide advice on how to gather evidence and may even have experience with similar claims.

Providing as much evidence as possible can strengthen your case against the claim that you were at fault. Good luck!
