Car hit while at dealership. Dealership says it’s my responsibility

Car damaged while at the dealership, and they’re claiming it’s my responsibility. My car was at the dealership for a tire rotation when another customer hit it, causing damage to the rear in the parking lot. The dealership insists they aren’t liable and that I should contact my insurance. Is that accurate? What are my options?

Update: The dealership provided photos. My car wasn’t parked in a designated parking spot; it was next to a red curb in the lot’s thoroughfare. The driver who hit me was towing a trailer and sideswiped my vehicle while making a turn to exit the lot.

Further update: My insurance mentioned there might be a case for negligence since the dealership parked my car in a problematic location, but they also affirmed that the other driver is at fault for not avoiding my car. The simplest course of action now is to file a claim through my insurance and see where it goes from there. They’ll send an investigator, and we’ll figure out next steps. I will need to pay my deductible upfront, but I should eventually get that refunded, although it may take some time. Fingers crossed!

  1. It sounds like a frustrating situation, and it’s good that you’re getting clarity on your options. Given that your car was parked next to a red curb in a thoroughfare, it complicates things a bit. Both the dealership and the other driver share some responsibility here, but since the other driver physically struck your vehicle, their insurance may ultimately be held liable.

Here are some steps you can take:

    1. Document Everything: Keep all communications with the dealership and insurance, as well as any photos of the damage and the parking situation.

    2. File a Claim: As you’ve mentioned, filing a claim through your insurance is a practical step. Make sure to explain the situation thoroughly, including the circumstances surrounding the accident.

    3. Negligence Assessment: Since your insurance indicated there might be a negligent claim against the dealership, it may be worth pursuing that avenue if you feel they were at fault for the unsafe parking situation.

    4. Reach Out to the Other Driver’s Insurance: If you have the other driver’s insurance information, contact them directly to see if they will cover the damages.

    5. Consider Legal Advice: If the situation becomes complicated or if you feel you’re not getting the answers you need, consulting with an attorney who specializes in auto accidents may provide additional options.

    6. Patience with the Process: It looks like you may have to wait a bit for the insurance investigation, so prepare for that.

Overall, it seems like you’re on the right track. I hope you’re able to resolve this quickly and without too much hassle!
