Excavation covered?

Is excavation covered?

I have a townhouse insured under a condo policy. Recently, a pipe located underground on HOA property broke, requiring excavation to identify the cause and replace the pipe. While I understand that the insurance denied coverage for the pipe repair due to wear and tear, shouldn’t they also cover the excavation costs associated with figuring out what happened? Other damages related to the incident were covered. This is under a Montana condo policy that includes backup water/sewer damage coverage on the HOA policy.

  1. It sounds like you’re dealing with a complicated situation involving your insurance policy and the responsibilities of the HOA. Generally, condo insurance typically covers damages to the interior of your unit, while the HOA’s master policy covers common areas and shared systems, including plumbing.

If the insurance company denied coverage for the pipe repair due to it being classified as wear and tear, they might hold that same standard when it comes to excavation costs related to that pipe. However, you may have a valid argument for the excavation costs if they were necessary to assess and address a covered cause of loss (such as sudden water damage that is not considered wear and tear).

To strengthen your case, you might want to:

    1. Review your policy: Look closely at the specific language of your condo insurance policy and the HOA’s master policy regarding what is covered, especially concerning excavation and investigation costs.

    2. Gather documentation: Collect any evidence that supports your claim, including contractors’ reports, communication with your HOA, and any relevant documentation regarding the incident and subsequent damage.

    3. Consult with your HOA: Discuss the situation with your HOA board or property manager. They may have insight into how similar claims have been handled in the past or be able to assist in appealing the insurance decision.

    4. Contact your insurance agent: They can provide clarification on the coverage specifics and possibly advocate on your behalf with the insurance company.

    5. Seek legal advice: If you believe the insurance company is wrongly denying coverage, consulting an attorney specializing in insurance claims might be beneficial.

Ultimately, the specifics of your situation and the details of the insurance policy will determine the outcome, so gathering as much information as possible will be essential in pursuing your claim.
