Who’s at Fault?

Who’s Responsible?
I’m looking for your thoughts on who might be at fault in this situation and the potential outcome regarding liability.

I had my vehicle pulled over on the shoulder to chain up due to poor road conditions. I realize this may not have been the ideal spot to stop, and I had my hazard lights on. On the opposite side of the road, there wasn’t a shoulder. The other driver seemed to be gliding before reaching my vehicle.

Update: Their insurance has accepted full liability.

  1. It sounds like you’ve already received a favorable outcome with the other insurance taking full liability, which is great news! From what you’ve described, it appears that you were parked on the shoulder with your hazard lights on, which indicates you were aware of the situation and were likely trying to stay safe. The fact that the other vehicle was observed gliding before the impact suggests that the driver may not have been paying adequate attention or could have been at fault for not maintaining control.

In situations like these, liability often hinges on factors such as the visibility of your vehicle, the actions taken by the other driver, and local traffic laws. Since you had your hazard lights activated, that may have also contributed to your position as the more cautious driver.

Overall, it seems like the insurance company’s determination of full liability on their end supports your account of the incident. It’s always a good idea to document everything and consider seeking legal advice if any further complications arise. Stay safe out there!
