Auto – California – I should have known better…

Auto Accident in California – Lesson Learned

I should have seen this coming. I was backed into while entering a driveway. After exchanging information, the other driver didn’t want to involve insurance—something I can understand, having been in a similar situation before. He was communicative throughout the process and even wired me the estimated repair costs. However, right before completion, the repair cost unexpectedly increased by $450, and he suddenly hesitated.

The car is now fixed, and I’ve paid the shop for the repairs. If the other driver had changed his mind during the repair process, both the service writer and I were prepared to get my insurance on board. But now that everything is finalized and he’s sent me the funds, is there anything my insurance can do to help? Or would this be better suited for a legal advice subreddit?

Appreciate any guidance! Lesson learned for next time: I’ll definitely be going through insurance.

  1. It sounds like you’ve had a frustrating experience, and it’s understandable to feel concerned about the situation. Since you’ve already received the payment for the repairs, your options might be limited now. Here’s what you might consider:

    1. Review the Agreement: If you and the other driver agreed on a specific amount for the repairs and he paid that amount, it might be hard to pursue further claims unless there’s a written agreement stating otherwise.

    2. Contact Your Insurance: Even though you’ve received payment, it might be worth contacting your insurance company to discuss the situation. They can provide you with clarity on what options are available, especially regarding the increased repair cost.

    3. Legal Advice: If you believe you have a strong case regarding the additional $450 and the other driver is refusing to pay, seeking legal advice might be beneficial. An attorney can guide you based on the specifics of your situation.

    4. Lessons Learned: As you mentioned, going through insurance in situations like these can sometimes save a lot of hassle. It provides more security in case issues arise after the fact.

Ultimately, it’s best to gather all your documentation (repair estimates, communications, etc.) and consult with professionals before making any decisions. Good luck!
