I really just need motivation and advise

I really need some motivation and advice.

To start, I do have an attorney, but her communication hasn’t been very clear, and I’m feeling quite confused as a result.

On November 1, 2024, I was rear-ended by a young driver who had just turned 21 and was not covered by his mother’s insurance. My car was totaled, and while they offered me $12,000, it was worth so much more. This incident isn’t my first—I was involved in another accident where I was not at fault on April 15, 2024, which turned out to be a hit and run.

I’ve undergone 2 CT scans and 1 MRI (which I had to fight for), revealing that I have several slipped discs in my neck and back. I have three physical therapy sessions left, and I’m scheduled for my second set of injections this Wednesday. Honestly, I’m feeling really depressed. I recently drove a rental car, but it made me extremely anxious. I tried seeking therapy, but my insurance denied me coverage.

It’s been five months since the accident, and while they accepted liability due to dash cam footage, I’m going a little stir-crazy waiting for a settlement. I miss my car, which I had for only six months. People keep suggesting I talk to various doctors, but I already see four different specialists. I just feel lost and overwhelmed.

Looking back, I wonder if I should have accepted the $4,000 offered by GAINSCO. I’m exhausted from this whole ordeal. How does the process work when attorneys are negotiating with both your insurance and the at-fault party? Any insights or encouragement would be greatly appreciated.

  1. I’m really sorry to hear about everything you’re going through. It sounds incredibly frustrating and overwhelming, especially with the ongoing medical issues and the stress of dealing with insurance and your attorney. Here are a few thoughts and suggestions that might help:

    1. Communication with Your Attorney: It’s crucial that you have a clear understanding of your situation. If your current attorney isn’t providing you with the clarity you need, consider scheduling a direct conversation to express your concerns. If communication doesn’t improve, it might be worth exploring the option of consulting with another attorney for a second opinion.

    2. Understand Your Value: You mentioned that you were offered $4,000 by Gainsco, but you believe your car and situation are worth much more. It’s essential to have a clear understanding of the actual damages, including medical bills, pain and suffering, and lost wages. If you haven’t done so already, gather all documentation related to your car’s value and your medical expenses, as this will support your case.

    3. Mental Health Support: Your mental health is just as important as your physical health. If therapy through your insurance didn’t work out, consider looking for community resources or support groups. Sometimes local non-profits or sliding scale therapists can offer affordable options. It’s important to prioritize your mental well-being during this tough time.

    4. Navigating the Settlement Process: Typically, your attorney will communicate with both your insurance and the other party’s insurance to negotiate a settlement. The settlement should cover all your damages, including repair or replacement of your vehicle, medical expenses, and any other damages incurred. Don’t hesitate to ask your attorney for a detailed breakdown of how the process works specifically for your situation.

    5. Taking Care of Yourself: In addition to physical therapy, make sure to take care of your emotional health. Find activities that help relieve stress, whether that’s reading, meditating, or spending time in nature. Even simple things can help alleviate some anxiety.

    6. Reach Out for Help: Don’t hesitate to lean on friends or family for support. Sometimes just talking through your frustrations can provide relief and clarity.

Stay strong, and remember that this situation is temporary, even though it feels overwhelming right now. You’re taking the right steps by seeking advice and being proactive about your health and well-being. Hang in there!
