Drunk driver totaled my car and now I’m up the river without a paddle

Navigating the Aftermath of a Drunk Driving Incident: Seeking Guidance

A few weeks ago, I experienced a situation that has left me feeling overwhelmed and unsure of my next steps. After a long day at work, I parked my car in front of my home, following my usual routine. Just ten minutes later, a drunk driver collided with my vehicle, causing significant damage to the rear.

As a resident of Minnesota, my car is vital for my job, as I specialize in delivering wedding cakes. The individual responsible for the accident was arrested on-site, but what followed has been a logistical headache. Dealing with his insurance company, The General, has proven to be nearly impossible, while my own insurer, State Farm, has been relatively cooperative.

There is, however, a significant complication. Insurance is set to cover approximately 75% of my car’s market value, which means I’m left with a $4,000 balance on a loan for a vehicle I no longer have. Regrettably, I was unaware of gap insurance when purchasing the car, which could have alleviated this particular issue.

I find it deeply frustrating that I have to bear this financial burden due to someone else’s reckless actions. Currently, I cannot afford to purchase a new vehicle, and my livelihood hinges on having reliable transportation for my work.

I am reaching out to see if anyone has advice or knows of additional steps I might take in this dire situation. Am I truly out of options, or is there still a way forward?

Update: I appreciate the insightful comments and corrections I’ve received. It seems I miscommunicated regarding the insurance payout. They will be providing the cash value of the vehicle, but I’m still left wondering how factors like brand-new tires come into play. Any further insights would be greatly appreciated! Thank you for your support.
