In the Wake of a Drunk Driving Incident: Navigating the Aftermath

A few weeks ago, I returned home after a long day at work and parked my car in front of my house, just like I always do. My routine was shattered when, just ten minutes later, a drunk driver crashed into the back of my vehicle, causing extensive damage.

Living in Minnesota, my car isn’t just a mode of transportation; it’s vital for my job as a wedding cake delivery driver. This incident has been a significant burden, as the responsible party was arrested and I’ve been left dealing with the aftermath.

To my dismay, the drunk driver’s insurance provider, The General, has been nearly impossible to communicate with. Thankfully, my own insurer, State Farm, has been relatively straightforward to work with. However, there’s a troubling reality—I’ll only receive about 75% of my car’s value from the insurance payout. This leaves me with approximately $4,000 that I still owe on my loan, despite no longer having a car to show for it. Unfortunately, when I purchased my vehicle, I was unaware of the concept of gap insurance, which could have alleviated some of this financial strain.

It feels profoundly unjust that I should bear the financial consequences of someone else’s reckless choice to drive under the influence. I’m now in a position where affording a new vehicle is nearly impossible, and my work heavily relies on having reliable transportation.

I’m reaching out for support and guidance—are there any potential options I might explore to remedy this situation, or am I really out of luck?

Update: After some insightful feedback from the community, I realized I misspoke regarding the insurance payout. They will indeed compensate me based on the car’s cash value. However, I’m left wondering, does the condition of the tires— which were brand new before the accident— have any bearing on the value? Any further thoughts would be appreciated!
