A few months ago, my wife was involved in an unfortunate incident where she was rear-ended by a driver operating a loaner car from a dealership. Despite filing a claim with our insurance and gathering the necessary information from the other driver, the situation has taken an unexpected turn regarding insurance coverage.

Initially, we collected the driver’s insurance details, which listed Geico as their insurer. We promptly filed a claim with our own insurance company and submitted an accident report. However, as the weeks went by, our insurance team struggled to locate the other driver, subsequently enlisting a third-party agency to assist with the search.

Recently, we received troubling news: the other driver did not, in fact, have coverage through Geico. Instead, it turns out they were insured with Nation General Insurance Company, which has now denied the claim for property damage. Their justification? The accident involved a loaner vehicle, which, according to their policy, doesn’t provide coverage unless specific documentation is in place prior to its use.

This revelation raises some pressing questions. How is it possible for someone to be driving a dealership’s loaner car without the necessary coverage? Shouldn’t the dealership have some form of insurance that protects these vehicles and, by extension, other road users? Our primary concern now revolves around whether reclaiming our deductible is feasible without resorting to legal action.

After discussing this situation with various individuals knowledgeable in insurance matters, it seems prudent to allow our insurance company to continue pursuing reimbursement on our behalf. Considering that our deductible is only $500, the costs and effort associated with legal action would likely exceed the benefits, making it an unwise pursuit.
