Title: Navigating Insurance Claims After an Accident with a Dealer’s Loaner Car
Recently, my wife was involved in an accident where she was rear-ended by a driver operating a loaner vehicle from a dealership while their car was undergoing repairs. Thankfully, she was able to collect the driver’s insurance information, which was initially identified as Geico, and subsequently, we filed a claim with our own insurance provider and reported the accident.
However, since that time, our insurance company has faced substantial difficulty in contacting the other driver to recover costs associated with our totaled vehicle and refund our deductible. To expedite the process, they enlisted the help of a third-party agency to track down the liable party.
Just last night, we received some unexpected news. It seems that the driver was not insured by Geico as initially thought but rather by Nation General Insurance Company. They have denied our claim for property damage, citing a lack of coverage since the loaner car did not have the necessary documentation in place at the time of the incident. According to their wording, “there is no property damage coverage for this matter because at the time of the loss, the loaner vehicle did not have documentation created to obtain the vehicle.”
This situation raises several questions. How is it possible for someone to operate a dealership’s loaner vehicle without any insurance coverage? Typically, one would assume that the dealership would have some form of insurance that applies in such cases. Moreover, what options do we have left in pursuing the refund of our deductible, if any, beyond engaging in legal proceedings?
Update: After reflecting on the responses I’ve received, it seems prudent to allow our insurance company to continue their efforts in recouping the costs. Since our deductible is only $500, pursuing legal action may not be worth the hassle or expense. We’ll keep our focus on working with our insurer to navigate this complex situation.
