Someone hit my car and their insurance says I’m 35% responsible.

Navigating Insurance Disputes: My Experience with an At-Fault Accident

Recently, I found myself in an unexpected and frustrating situation involving a car accident. I was navigating through a gas station parking lot at a very low speed when a driver, reversing from their parking space, collided with the passenger side of my car. Given that I was only traveling at about five miles per hour, I was confident that the fault did not lie with me.

To support my case, I obtained video footage from the gas station that clearly demonstrates my innocence in the incident. However, despite this evidence, the other driver’s insurance provider, State Farm, determined that I am 35% at fault, which feels incredibly unfair given the circumstances.

I reached out to a supervisor at State Farm in an attempt to resolve this issue, but unfortunately, my conversation didn’t lead to any progress. This has left me feeling stuck and uncertain about my next steps.

To add context, I have full coverage along with collision insurance—this means I am protected should situations like this arise. However, the fact that they are still attributing some blame to me complicates matters considerably.

I’m reaching out to others who may have faced similar challenges: what would you recommend I do next? Has anyone had success in disputing an insurance claim that they believed was unfair? Any advice on how to navigate this daunting process would be greatly appreciated.

As I continue to address this issue, I hope to share my experiences and any lessons learned along the way. Stay tuned for updates, as I explore options to ensure that my rights are upheld in this frustrating situation!
