Was in an auto accident last year where the other driver was 100% at fault. Yesterday I received an email from my insurance that they are no longer seeking collections action against the third party & authorize me to seek action to recover my deductible. What should I do?

Navigating the Aftermath of an Auto Accident: Seeking Recovery of Your Deductible

Last year, I experienced a difficult situation when I was involved in an auto accident caused entirely by another driver. Recently, I received a message from my insurance company indicating that they will no longer pursue collections from the responsible party and have instead authorized me to take steps toward recovering my deductible. Now, I find myself at a crossroads and I’m unsure how to proceed.

A Brief Background

To give you some context, I’m a 33-year-old female living in Austin, Texas. I’ve encountered significant challenges throughout this process, including difficulties in reaching my previous insurance provider for clarification on their recent email. My attempts to call have resulted in dropped calls or automated messages that don’t allow me to leave a voicemail.

The email I received outlined the following:

“In accordance with Section 542.204 of the Texas Insurance Code, we are notifying you that regarding the recovery of your deductible or our subrogation interest, we will not be taking further collection actions against the liable third parties. Thus, you are authorized to pursue recovery of your deductible against them, if you wish, at your own expense. Please note that any legal action taken must be within two years from the date of your accident.”

It’s been quite a while since I received any updates on the case or arbitration; the last communication was back in September. Given the circumstances, I’m at a loss on what my next steps should be. Should I consider seeking legal advice? And if so, how do I go about finding representation without financial resources?

The Accident’s Impact

To recap what happened: while I was driving, another motorist merged into my lane recklessly, which caused my vehicle to collide with a highway barrier, resulting in my car being totaled. The other driver was deemed to be 100% at fault. Unfortunately, their insurance initially contended this due to a mistake in the original police report—where the vehicles were misidentified. I promptly alerted the officer to rectify the report, but this has led to a cumbersome paperwork situation; the other driver’s insurance persistently disregarded the corrected details and relied on the flawed initial report. I’ve made multiple attempts to resolve this directly with both their insurance and mine with little success.

Seeking Guidance

I’m reaching out because I feel overwhelmed by this situation and desperate for insights. I want to understand the best course of action to regain my deductible
