Recently, I received an unexpected email from my insurance company stating that they would no longer pursue collection actions against the liable party and have authorized me to take steps to recover my deductible. A Frustrating Experience with Insurance

Despite several attempts to contact my old insurance company for clarification, I faced repeated difficulties—calls dropping and landing me in voicemail purgatory where I couldn’t leave messages. The email I received contained critical information, referencing Section 542.204 of the Texas Insurance Code. It stated that my insurance would not continue pursuing the third-party, effectively handing the reins to me to seek recovery of my deductible independently. It’s clear that action must be taken within two years of the accident, but I’m unsure of the next steps.

The Accident and Its Aftermath

To provide some context, the accident occurred when a driver negligently merged into my lane on the highway, causing me to smash into the cement barrier, ultimately totaling my vehicle. Although the other driver was deemed fully responsible, their insurance initially contested the claim due to an incorrect police report that misidentified the vehicles involved. I immediately rectified the report with the officer, but the other insurance company continued to disregard this correction, clinging to the initial error. This led to a frustrating back-and-forth as I tirelessly communicated with both my insurance and theirs to ensure accurate documentation.
