Dealing with the aftermath of a car accident caused by an intoxicated driver can be overwhelming, especially when the financial and emotional toll feels insurmountable. Here’s a recent experience shared by someone facing this difficult situation, along with insights that might help others in similar circumstances.

The incident occurred just a few weeks ago when, after returning home from work in Minnesota, I parked my vehicle outside my residence as I normally do. Within ten minutes, a driver under the influence collided with the rear of my car, causing extensive damage to the entire back end.

Living in Minnesota and relying heavily on my vehicle for work—particularly for delivering wedding cakes—the situation has become especially dire. The responsible party was arrested, which is a small consolation, but the insurance process has been a challenge. The at-fault driver’s insurer, The General, refused to engage with me directly. Conversely, my own insurer, State Farm, has been more cooperative.

However, the financial repercussions are significant. Insurance compensation only covers approximately 75% of my car’s current market value, leaving me with a balance of nearly $4,000 on my auto loan. When I purchased the vehicle, I was unaware of gap insurance, which might have mitigated this issue, but unfortunately, it doesn’t apply in my case.

It feels unfair to be financially burdened for a car I no longer possess due solely to someone’s reckless decision to drive intoxicated. With limited funds and urgent work commitments, I’m now faced with difficult choices. Is there any recourse or options available to me? Or am I simply out of luck?

After some clarifications, I realize that insurance is paying the actual cash value of my vehicle. Does having brand-new tires make a difference in this valuation? I’m unsure of how such details are factored into the settlement.
