Navigating the Aftermath of a Drunk Driving Collision: What Victims Need to Know
Recently, I experienced a situation that has left me feeling overwhelmed and financially strapped. It all started when I returned home from work and parked my vehicle in its usual spot in front of my house. Just ten minutes later, a driver under the influence of alcohol crashed into the back of my car, causing extensive damage to the entire rear end.
Living in Minnesota, I rely heavily on my vehicle for daily responsibilities, including my job delivering wedding cakes. The driver responsible was promptly arrested, but since then, the ordeal has only worsened. The at-fault driver’s insurance provider, The General, has been uncooperative and refuses to engage with me directly. Fortunately, my own insurer, State Farm, has been more responsive and communicative.
However, a significant issue remains: the insurance payout only covers approximately 75% of my vehicle’s current market value. This means I am left with about $4,000 remaining on my auto loan — an amount I cannot easily pay, especially since I was unaware of the importance of gap insurance when purchasing the vehicle. Unfortunately, gap coverage isn’t an option for me at this point.
This situation feels unfair, as I am being held financially responsible for a total loss caused by someone else’s reckless decision to drive intoxicated. I am not in a position to buy a new vehicle at the moment, and my livelihood depends on having reliable transportation.

After some discussion, it appears that my insurance is covering the actual cash value of the vehicle rather than replacement cost. Does the fact that my tires were brand new influence the payout? I’m unsure how these details impact the settlement.
