Experiencing a car accident caused by a drunk driver can be incredibly distressing, especially when it results in the total loss of your vehicle. Recently, a personal situation highlighted the complexities involved in such incidents and the challenges victims face in recovering their losses.
A few weeks ago, I parked my vehicle in front of my home in Minnesota after returning from work—a routine I had followed for years. Within ten minutes, a driver under the influence crashed into the rear of my car, damaging it extensively. The aftermath was a whirlwind: the intoxicated driver was arrested, but the insurance saga that followed proved to be a difficult journey.
The at-fault driver’s insurance company, The General, refused to communicate directly with me, which added to my frustration. Fortunately, my own insurer, State Farm, was more responsive, but coverage issues soon arose. Unfortunately, the settlement only covers approximately 75% of my car’s market value, leaving me with around $4,000 remaining on my auto loan—an unexpected financial burden.
I was unaware of gap insurance at the time of purchase, so it isn’t an option now. Many of you are correct—my insurance is covering the car’s actual cash value. However, I’m wondering: does the condition of the tires, such as being brand new, influence the valuation? I’m not sure how this factors in, and I’d love to understand more.
