Was in an auto accident last year where the other driver was 100% at fault. Yesterday I received an email from my insurance that they are no longer seeking collections action against the third party & authorize me to seek action to recover my deductible. What should I do?

Understanding Your Insurance Communication and Next Steps After a Car Accident

A year ago, I was involved in a car accident where the other driver was entirely at fault. The incident resulted in my vehicle being totaled, and I had to cover a deductible out of pocket. Recently, I received an update from my insurance provider that has left me uncertain about what actions I should take moving forward. I’m seeking guidance on how best to navigate this situation.

Background of the Incident

The accident occurred when a negligent driver merged into my lane, causing me to crash into the highway’s concrete divider. The police report initially misclassified the fault, erroneously identifying my vehicle as the one that caused the collision. Fortunately, I quickly corrected this error with the officer and communicated it to both the police and insurance companies. Despite these efforts, the insurance company continued to rely on the incorrect report, complicating the claim process.

Recent Insurance Notification

Yesterday, I received an email from my insurance company stating:

“In accordance with Section 542.204 of the Texas Insurance Code, we are notifying you that we will no longer pursue collection actions against the liable third party(ies) concerning your deductible or our subrogation interest. You are authorized to take legal action to recover your deductible amount at your own expense. The statute of limitations for negligence claims related to property damage in Texas is two years from the date of the accident. Any such legal action must be initiated within this timeframe.”

This message essentially grants me permission and a deadline to pursue legal recourse to recover my deductible, but I am unsure how best to proceed, especially since I haven’t received any updates or further guidance since September.

Challenges Faced

  • The initial police report contained inaccuracies, complicating insurance negotiations.
  • Insurance firms disregarded the corrected information, delaying resolution.
  • I have limited financial resources and have exhausted much of my savings due to repairs and medical expenses.

Seeking Advice

Given these circumstances, I am uncertain whether I should consult an attorney and how to do so on a limited budget. Do I need legal representation to pursue the responsible party for my deductible? What steps should I take now to protect my rights and pursue recovery?

Your insights and recommendations would be greatly appreciated. I’m feeling overwhelmed but hopeful to find a path toward resolving this issue and recovering what I’m owed.

Thank you for your assistance.
