Experiencing a car accident can be overwhelming, especially when it involves multiple vehicles and significant damage. Recently, I found myself in a three-car collision that left my vehicle severely damaged. While I was stopped at a red light, I was rear-ended, which caused my car to crash into the vehicle in front of me. As a result, my car sustained extensive damage, including a crushed trunk and front end, while the other vehicles involved only had minor bumper issues.

Fortunately, a police report was filed, and the insurance company of the driver who hit me has acknowledged their liability for the damages sustained by both parties. However, complications have arisen due to what I’ve been informed is a “limits issue.” In my home state of Illinois, the minimum coverage required is $20,000, which is problematic considering that this amount is nearly double the value of my car.

The insurance company has indicated that they cannot proceed with any payouts until the repairs for the less-damaged third car, being serviced by State Farm, are completed. It has been nearly two weeks since the accident, and my vehicle remains non-operational, parked in my garage. Unfortunately, I have yet to receive substantive updates regarding the claims process from either State Farm or the at-fault driver’s insurance.

With this in mind, I’m reaching out to the community for insight into potential actions I can take to expedite the process. Specifically, I’m curious about the following:

  1. Legal Waiting Periods: How long can the at-fault driver’s insurance company legally delay payments before I can push back or seek alternative solutions?

  2. Repair Priorities: Why am I being required to wait for the repairs of the other vehicle, especially when I’m the one who sustained the most significant damage in the incident?

  3. State Farm’s Role: I have coverage with State Farm as well. Are there any avenues available through them that could assist me in expediting my repairs, besides the option of applying my deductible, which I cannot afford to use at the moment?
