Experiencing a car accident caused by a drunk driver can be an overwhelming and stressful situation, especially when it leads to significant financial and logistical challenges. Recently, I faced such an ordeal when my vehicle was totaled after a DUI incident right outside my home in Minnesota.

That evening began like any other—parking my car safely in front of my residence after work. However, just ten minutes later, a driver intoxicated behind the wheel collided into the rear of my car, causing extensive damage to the entire back end. As a daily commuter reliant on my vehicle for my job, the loss has been particularly impactful.

The responsible driver was promptly arrested, but since then, I’ve encountered a series of hurdles. His insurance provider, The General, has been uncooperative, refusing to communicate or provide any assistance. Fortunately, my own insurer, State Farm, has been more responsive, but the coverage constraints remain a concern.

Unfortunately, the settlement I received only covers approximately 75% of my car’s value. This leaves me with a remaining balance of around $4,000 on my auto loan—a debt I now have to settle despite the vehicle being beyond repair. I wasn’t aware of gap insurance when I purchased the car, so I’m left searching for options.

It feels unjust to be financially responsible for a vehicle I no longer possess because someone else made the reckless choice to drink and drive. Currently, affording a new vehicle isn’t feasible, and my livelihood hinges on having reliable transportation—I deliver wedding cakes for a living, after all.

Are there any avenues I might explore to alleviate this burden? Could legal action, assistance programs, or other resources help in such a situation? Any guidance or experiences you can share would be immensely appreciated.

Many of you pointed out that my insurance is actually covering the vehicle’s cash value, including factors like recent tire replacements. I appreciate the clarification and will consider how this affects my options moving forward.
