Someone hit my car and their insurance says I’m 35% responsible.

Navigating Insurance Disputes After a Minor Car Accident

Recently, I experienced a frustrating situation involving vehicle damage and insurance claims. While driving through a gas station parking lot at a slow pace—approximately 5 miles per hour—another driver backed out of a parking space and struck my passenger side door. Fortunately, I was able to obtain surveillance footage from the gas station, clearly indicating that I was not at fault in the incident.

Despite this evidence, my insurance provider—State Farm—has assigned 65% liability to me, effectively holding me responsible for over a third of the damages. I escalated the matter by speaking with a supervisor, but unfortunately, I haven’t seen any resolution or change in their assessment.

It’s important to note that I carry comprehensive and collision coverage on my policy, and the other driver’s insurance is with State Farm. Given this context, I am seeking advice on how to proceed and whether there are steps I can take to challenge the liability determination or seek further resolution.

If you have experience dealing with similar insurance disputes, particularly when clear evidence suggests the other party is at fault, I would appreciate your insights. Understanding the pathways to contest liability assessments can help protect drivers in situations like this when faced with unfair insurance claims.
