Neighbor won’t cooperate with their insurance company

Neighbor is Uncooperative with Insurance Company

Two months ago, my parked car was rear-ended by my neighbor, who admitted fault and provided her insurance details. Unfortunately, we were caught up with family events at the time and didn’t file a police report. Now, my neighbor has been unresponsive to her insurance company’s attempts to reach her, and they’re threatening to deny the claim. What are my options? Is it possible to obtain a police report after the incident? Should I consider taking legal action? I do have photos from that night and security camera footage, but it doesn’t show my car clearly. Any advice would be appreciated!

  1. I’m sorry to hear about your situation; it sounds really frustrating. Here are some options you might consider:

    1. Follow up with the Insurance Company: Contact your insurance company and inform them of the situation. They may be able to help you push for a resolution or advise you on how to proceed with your claim given the neighbor’s lack of cooperation.

    2. Obtain a Police Report: While it can be challenging to get a police report after the fact, you might still be able to request one, especially if you can show that an accident occurred. Reach out to your local police department to see if they have any record of the incident.

    3. Documentation: Keep all your documentation in order, including photos of the damage and any communication with your neighbor and their insurance company. This will be useful if you need to escalate the situation.

    4. Small Claims Court: If the insurance company denies the claim due to the neighbor’s non-cooperation, you may consider taking the matter to small claims court. You’ll need to prepare your evidence, including the photos and any correspondence you’ve had regarding the incident.

    5. Consult Legal Advice: It might be helpful to consult a lawyer who specializes in auto accidents. They can provide guidance based on your specific situation and help you understand the best legal recourse available.

    6. Mediation or Settlement Discussion: You might also consider reaching out directly to your neighbor (if you feel comfortable) to discuss the situation. Sometimes a direct conversation can lead to a quicker resolution.

I hope this helps, and that you are able to resolve the issue with your neighbor soon!
