Insurance claiming driver was never added to plan

Insurance Claim Issue: Not Listed on Policy

Hi everyone, I need some advice. I was in an accident last Tuesday when a truck ahead of me hit a deer on the highway. I didn’t manage to stop in time and ended up running over the deer, which damaged my front bumper, but fortunately, there were no other vehicles involved.

However, I recently reached out to the insurance company and discovered that I was never added to the policy. I distinctly remember the policyholder calling to add me as soon as I got my license back in December.

To make matters worse, I received a letter from the BMV asking for a Certificate of Compliance (COC), and I’m not sure how to obtain that since I’ve been told I wasn’t insured. While the vehicle was insured, I personally was not. Is there any way to contest this situation, or am I out of luck? Any help would be greatly appreciated!

  1. I’m really sorry to hear about your situation; that sounds incredibly stressful. Here are some steps you can take to address the insurance issue and the request from the BMV:

    1. Gather Documentation: Collect all relevant paperwork, including any texts or emails that confirm your addition to the insurance policy, along with your insurance card that shows you were insured. Keep a record of the date when the policyholder said you would be added.

    2. Contact the Insurance Company: Reach out to the insurance company again to clarify the situation. Explain that you were told you would be added to the policy and provide any documentation you have that supports your claim. Ask for a supervisor if necessary to escalate the issue.

    3. Written Statement: If the insurance company still insists you were never added, consider writing a formal letter summarizing your case and asking for clarity on their records. Sometimes, putting things in writing can prompt a more thorough investigation.

    4. Check State Regulations: Look into your state’s insurance regulations regarding uninsured drivers. This can help you understand your rights and whether there are any protections available to you in this situation.

    5. Seek Legal Advice: If you’re facing serious complications, like the possibility of fines or legal consequences, you might want to consult with an attorney who specializes in insurance or traffic law. They can offer guidance based on your specific circumstances.

    6. Respond to the BMV: Contact the BMV to explain the situation. They might allow you some leeway if you’re actively trying to resolve the insurance issue.

    7. File a Complaint: If you believe the insurance company is wrongfully denying your coverage, you can file a complaint with your state’s insurance department.

While this situation is certainly challenging, staying organized and proactive can help you navigate these issues more effectively. Good luck!
