Accident Involving a Non-Insurance Company: Seeking Guidance

Two weeks ago, I was rear-ended by a commercial truck belonging to a logistics firm, XYZ. Initially, I filed a claim through their insurance provider, ABC, as indicated on the driver information exchange. However, I was soon informed by ABC that the logistics company, XYZ, would be responsible for covering the accident and I was provided a claim number with them.

Unfortunately, I can only reach XYZ via email, and their responses are quite slow. Their phone line is perpetually busy. After submitting all requested information, the only reply I received was that they are currently “reviewing” the case and will update me once that process is complete—without any indication of how long that might take. Since they are not a traditional insurance company, I assume their claims handling process differs from the norm.

Now, more than two weeks have passed, and I still have no clarity on how they intend to address this situation.

Are there any legal obligations regarding their response and resolution timelines? I would prefer not to go through my own insurance and incur out-of-pocket expenses.

What steps can I take to encourage them to expedite their review?

I would greatly appreciate any advice or suggestions! Thank you!

  1. I’m sorry to hear about your situation; it sounds very frustrating. Here are some steps you can take to encourage progress:

    1. Follow Up Regularly: Since you’ve already emailed, follow up with another email and consider sending a formal letter to the company. Document all your attempts to communicate (dates, times, and content). If possible, find a different contact method, such as reaching out through social media or looking for a contact person or department within the company.

    2. Request a Timeline: In your follow-up communication, directly ask for a timeline for when you can expect a decision on your claim. While they may not be obligated to give a specific timeline, asking shows that you are serious about resolving the issue.

    3. Check Your Local Laws: While there’s no standard timeframe that all companies must adhere to for claims resolution, many states have laws regarding claims handling, especially for insurance companies. Research your local consumer protection laws or consult with a legal expert to see if there’s a relevant regulation that applies to your situation.

    4. Contact a Personal Injury Attorney: If you don’t see any response soon, considering consulting with a personal injury attorney might be wise. They can help you understand your rights, negotiate on your behalf, and may expedite the process.

    5. File a Complaint: If the company continues to be unresponsive, consider filing a complaint with the Better Business Bureau or your state’s attorney general. This could prompt them to take your claim more seriously.

    6. Gather Documentation: Keep all records, including accident reports, medical expenses, and any repairs related to the accident. This documentation may help expedite the process once they are ready to resolve your claim.

    7. Consider Mediation or Arbitration: If the company still fails to respond adequately, look into whether they have any mediation or arbitration processes in place. This can be a way to resolve disputes without going to court.

Remember to stay persistent but professional in your communications. Good luck!
