Hit and Run Incident
About three weeks ago, my husband and I were in our car when we were struck by another vehicle that then fled the scene. Fortunately, we were able to track down the car, which was hidden in a one-way alley. When the driver finally emerged, they claimed that we had hit them, which has complicated matters. Their insurance is denying liability, despite my insurance company indicating that they might not take responsibility.
On a positive note, I managed to capture video footage of the accident thanks to a kind neighbor, and another neighbor witnessed the incident and has agreed to serve as our witness. I’ve also filed a police report regarding the hit and run.
Given that their insurance seems uncooperative and they’ve hired a lawyer, what would you recommend I do next? Should I reach out to their insurance company directly?
I’m sorry to hear about your experience; that sounds really stressful. Since you have video footage and a witness, you have some strong evidence on your side. It’s a good idea to stay in touch with your insurance company, as they’ll know how to handle this situation best. They can also give you advice on whether it’s worth contacting the other party’s insurance company directly.
If their insurance is being uncooperative, your next steps might include:
Provide Evidence: Share the video footage and witness statements with both your insurance and their insurance. This evidence should help support your case.
Consult a Lawyer: Since they’ve hired a lawyer, it might be beneficial for you to consult with one as well, especially if things escalate or if you’re feeling overwhelmed. They can guide you through the process and help protect your interests.
Stay Organized: Keep all documentation related to the incident, including the police report, any correspondence with insurance companies, and details of your conversations with witnesses.
Follow Up Regularly: Stay proactive with both your insurance and theirs. Regular follow-ups can sometimes expedite the process.
Don’t hesitate to seek professional legal advice if needed. Best of luck, and I hope everything gets resolved smoothly!
