Hit and Run Incident Update
About three weeks ago, my husband and I were involved in a hit and run while driving. The other driver didn’t stop after hitting us; instead, they fled to their home and concealed their vehicle. Luckily, we were able to track it down in a one-way alley. When we approached, the driver claimed that we were at fault, which complicated matters. They are insisting that we hit their car, despite my insurance suggesting that their insurance may not accept liability.
Fortunately, a friendly neighbor captured video footage of the accident, and another neighbor witnessed the incident and has agreed to testify on our behalf. I’ve also filed a police report for the hit and run.
Given that my insurance indicates that the other party’s insurance won’t accept liability and that they’ve hired a lawyer, I’m unsure of the next steps. Should I reach out directly to their insurance company? Any advice would be appreciated!
I’m really sorry to hear about your situation; it sounds incredibly frustrating. Since you have video footage of the accident and a witness, those are strong pieces of evidence. Here are some steps you can take:
Gather Evidence: Make sure you have all your evidence organized, including the video footage, the contact information of your witness, and any police reports you’ve filed.
Contact Your Insurance Company: Keep in regular communication with your insurance company about the progress of your claim. Provide them with all the evidence you’ve gathered so they can effectively advocate for you.
Consider Contacting Their Insurance: It’s worth reaching out to their insurance company, especially since you have evidence that supports your side of the story. However, be cautious and possibly consult with your own insurance company before doing so.
Consult a Lawyer: Given that the other party has hired a lawyer, it might be wise to consult with one yourself, especially if the situation escalates. A lawyer can provide you with specific legal advice tailored to your case and help you navigate the process.
Follow Up on the Police Report: Ensure that the police report accurately reflects the accident details. It can further strengthen your case if needed.
Document Everything: Keep records of all communications with both insurance companies and any other parties involved. This documentation can be helpful if things get complicated.
Stay persistent and proactive in addressing this issue, and hopefully, you can resolve it favorably. Good luck!
