Got rear ended by semi truck

I was rear-ended by a semi-truck on October 17th. The state police filed a report and determined that the truck driver was at fault. The impact caused me to collide with two other vehicles: I side-swiped a white BMW and grazed the corner of a truck before I slowly rolled into the median. Immediately after the accident, I developed a severe headache. After exchanging information and involving the police, I went to the hospital, where they diagnosed me with a mild concussion. The following day, my primary care doctor put me on light duty for two weeks to allow my concussion symptoms to subside. After those two weeks, I still had symptoms, so she extended my light duty for another week.

Three weeks after the accident, once I was cleared, I began experiencing lower back pain. I started receiving massages and chiropractic therapy. By November 15th, I was making good progress with my therapy. However, I started a full-time job at the beginning of the year, which made it difficult to continue regular chiropractic visits. As a result, I stopped going for about a month to a month and a half. February was particularly tough for me; I battled the flu and ended up with pneumonia, forcing me to take about three weeks off work.

I want to resume therapy, but I’m concerned about how the extended break might impact any potential settlement. I’m also considering hiring a lawyer and would appreciate any advice on what steps I should take moving forward.

  1. I’m really sorry to hear about your accident and the challenges you’ve been facing. It sounds like you’ve been through a lot. It’s important to prioritize your health, so getting back into therapy is a good idea. Regarding your concerns about the gap in treatment, while it’s generally better to maintain consistent care, the fact that you had legitimate health issues like the flu and pneumonia may be understandable reasons for the break in therapy.

When you do consult with a lawyer, make sure to explain your situation, including your initial treatment, the setback due to illness, and your intent to return to therapy. They can help you document everything and navigate the settlement process, including addressing any potential concerns that arise from the gap in treatment. Having a lawyer will also ensure that you are treated fairly and that all relevant factors are taken into account in your case. Stay strong, and take care of yourself!
