About a month ago, I was involved in an accident where I wasn’t at fault, and unfortunately, my car was deemed a total loss, valued at approximately $24,000. The driver responsible for the accident only has a maximum coverage of $10,000. To make matters worse, I don’t have collision coverage (I realize now that was a mistake).
I do have uninsured/motorist bodily injury coverage of $15,000/$30,000, and uninsured motorist property damage coverage of $3,500, but I believe this last one doesn’t apply in my situation.
My question is: can I accept the payout from the at-fault driver’s insurance and still pursue my own insurance company (Progressive) for compensation for my medical expenses? I don’t intend to pursue legal action against the driver, so I’m worried that I won’t be able to recover my losses. Any advice would be greatly appreciated!
