Frustration with Toyota Insurance: Poor Communication Throughout My Claim Process

A couple of months ago, I was involved in a minor fender bender. I was exiting a parking lot and needed to go straight, but I found myself in a right-turn-only lane. As I prepared to merge left into a lane that allowed for both right turns and going straight, I checked my left mirror for space while also watching for vehicles turning right to avoid a potential collision.

I noticed that there was ample room behind Vehicle A, which had just passed me. However, while I was focusing on my mirror, Vehicle A accelerated without signaling, leading me to believe they were going straight. I slowed down to let them pass, but suddenly they made a sharp right turn, seemingly in a hurry. They didn’t see me, but I did my best to avoid a collision by steering along with them, resulting in a classic fender bender.

Just moments after the collision, Vehicle A’s dad arrived and handled most of the conversation. He suggested that I should consider whether going through insurance was worth the hassle, which felt discouraging and implied that they believed they were at fault. When the police arrived, the officer quickly deemed me at fault without gathering comprehensive details, even though Vehicle A had police plates. The cop exhibited a hostile attitude when I inquired about retrieving traffic camera footage that clearly captured the incident, yet I was not cited.

Fortunately, I managed to obtain the traffic camera footage and submitted it as evidence for Vehicle A’s claim. During a phone call with the adjuster, she indicated that it might be deemed a case of shared fault due to the unsafe lane change and the opposing driver’s failure to signal, which the footage demonstrated. I was assured I would be contacted before a final decision was made.

When the claim was officially closed in mid-February without any communication from Toyota Insurance, I assumed the claim had been denied. However, when I contacted the adjuster today, I was informed that the case was closed and that I was deemed 100% liable for the “unsafe lane change.” I asked for clarification on the change from the initial assessment of double fault, but my questions went unanswered; I was simply told that a letter would be resent. The letter contained minimal information and didn’t explain the rationale behind the liability determination.

I am extremely frustrated that the other driver walks away without any repercussions for their negligence. The outcome seems unjust, as it implies that I caused the incident by merging into a lane while Vehicle A abruptly turned into my path.

Is this a reflection of a subpar insurance company, or is poor communication a common issue when it comes to insurance claims?
