Today, I’m reaching out to share my experiences and seek advice regarding an auto accident I was involved in last year. I’m a 33-year-old female based in Austin, Texas, and this is my first time posting here. I’m relatively new to dealing with insurance and legal matters, so any insights would be truly appreciated.

Last year, I found myself in an unfortunate situation when another driver merged into my lane on the highway without warning, causing me to crash into the concrete barrier. Thankfully, it was determined that the other party was entirely at fault. Despite this, I’ve faced a series of challenges navigating the aftermath, particularly with insurance companies.

Just yesterday, I received an email from my old insurance company that I found both surprising and confusing. The message stated:

“In accordance with Section 542.204 of the Texas Insurance Code, we would like to inform you that we will no longer pursue collection actions against the third-party responsible for your claim. As a result, we authorize you to initiate your own efforts to recover your deductible from the liable party, at your discretion and expense. Please note that any legal proceedings must be initiated within two (2) years from the date of the accident.”

I have been trying to reach my insurance company today to gain clarity on this issue, but unfortunately, my calls keep disconnecting or lead to voicemail where I am unable to leave a message. It’s been quite frustrating, especially since I haven’t received any updates regarding the arbitration process since September.

Given the circumstances, I’m wondering if I should consult with a legal professional. However, I’m currently in a tight financial situation, as this accident has drained my funds.

The complexities continued when the other party’s insurance contested the claim based on an initial police report that inaccurately presented the situation—misidentifying which vehicle was at fault due to a mix-up in the report. I took immediate action to rectify this once it was published, but unfortunately, the corrections have not been acknowledged by the other insurance entity, resulting in numerous headaches.

So here I am, feeling a mix of defeat and determination, seeking guidance on what my next steps should be to reclaim my deductible.
