Auto Accident Advice Needed
I’m feeling really anxious about a situation I found myself in, and I’m hoping to get some advice.
A couple of weeks ago, I was driving my partner’s car (she was with me) when we were in a car accident. Though I’m not listed on the insurance policy, her parents’ plan permits friends and family to use the car. The police were involved since it was an accident, but as far as I know, no report was filed and no tickets were issued — we just exchanged information. I managed to drive the car home afterward, and her parents chose not to file a claim since the car, a 2002 Civic, had damage that would exceed its value to repair. The main issue was that the front end was crumpled and the engine may have been pushed back.
Recently, the other driver involved has opened a claim and retained an attorney, which has led her parents’ auto insurance to open a claim as well.
To add to my worry, the accident occurred around 2 a.m., and there were no traffic cameras or dash cams to provide evidence. I was driving at about 25-30 mph (the speed limit was 35 mph), but it was raining, and it felt like the other driver was speeding and ran a red light.
Now I’m concerned about the possibility of being sued and held liable for damages, and I’m unsure of what steps to take. As a college student with limited funds, I’m worried I wouldn’t be able to cover any potential costs. Any guidance would be greatly appreciated!
First and foremost, it’s completely normal to feel anxious in a situation like this—accidents can be really stressful. Here are some steps you can take to help navigate your concerns:
Communicate with Your Partner’s Parents: Since they own the car and their insurance is involved, it’s important to keep them in the loop. They might have advice or be able to take steps to protect you.
Understand the Insurance Policy: Since the insurance allows friends and family to drive the car, this may provide some protection. Clarifying details with the insurance company could help you understand if you’re covered in case of a claim or lawsuit.
Consult with an Attorney: If you’re feeling particularly anxious about the potential for being sued, it might be worth scheduling a consultation with an attorney. Some offer free initial consultations and can provide tailored advice based on your specific situation.
Stay Calm and Gather Information: Make sure you have all the facts straight regarding the accident. While it’s unfortunate that you didn’t have a police report, keeping records of what happened can be beneficial.
Don’t Ignore Communications: If you do receive any communication regarding a potential lawsuit or claim, don’t ignore it. Respond promptly and consult with a legal professional when necessary.
Focus on Whatever You Can Control: While you can’t change the past, you can take proactive steps moving forward. Focus on your studies and maintaining your mental well-being.
Consider Getting Insured: For the future, it might be worthwhile to look into getting your own auto insurance. This could provide peace of mind when driving someone else’s vehicle.
Remember, you’re not alone in this, and there are people who can help guide you through it. Try to take it one step at a time!
