Collision with an insured vehicle but an unlicensed non US citizen

I was involved in a collision with a car insured by Progressive, but the driver was unlicensed and a non-US citizen. He had permission from the car’s owners to drive it. Thankfully, no one was injured, and the driver admitted fault, which is documented in the police report.

After contacting my insurance company for guidance, they mentioned that Progressive might deny coverage since the driver is unlicensed and may not qualify as a permitted driver. I’m uncertain if my vehicle, which is brand new, will be totaled.

Has anyone dealt with a similar situation? What should I expect moving forward, and how should I handle this? I’ve already started the claims process with Progressive.

  1. It sounds like a frustrating situation, but you’re taking the right steps by filing a claim with Progressive. Here are a few things to consider as you navigate this process:

    1. Claim Filing: Since you’ve already started the claim with Progressive, make sure to provide them with all the details, including the police report, photographs of the scene, and any witness statements if available. This will help bolster your case.

    2. Permitted Driver Definition: As you mentioned, the fact that the driver is unlicensed may complicate the coverage determination. Progressive may consider whether the owner of the vehicle had knowledge of the driver’s unlicensed status, as this could influence whether they are considered a “permitted driver.”

    3. Communicate with Your Insurer: Keep your own insurance company in the loop regarding the claim process. They may provide additional insight or support, especially if there are complications with receiving coverage from Progressive.

    4. Potential Outcomes: If Progressive denies coverage due to the driver’s unlicensed status, they should provide you with a clear explanation. If the claim is processed, they will assess the damages to determine if the vehicle is repairable or if it is a total loss.

    5. Consider Legal Guidance: If you encounter difficulties with the claim or feel that you are not being treated fairly, consulting a lawyer who specializes in insurance claims may be beneficial. They can help you understand your rights and potential next steps.

    6. Follow Up Regularly: Stay in close contact with Progressive for updates on the status of your claim, and don’t hesitate to ask questions if you’re unsure about any part of the process.

Hopefully, you’ll get resolution soon, and your vehicle situation can be handled efficiently!
