Insurance Company Delaying Payment
I experienced significant damage to my building from a truck collision. After extensive back-and-forth, the truck’s insurance company accepted liability and provided me with a general release form for my property damage claim in order to process payment. However, it has now been 4 weeks, and I still have not received any payment. For reference, I have email confirmation indicating that payment was supposed to be issued about two weeks ago.
Despite my efforts to reach out via email and phone, the insurance company for the at-fault driver has been unresponsive.
I’m looking for advice on my next steps. I initially hesitated to involve my own insurance company due to the claim amount (~$20k).
Should I consider bringing my insurance company into this situation to expedite payment or to potentially void the release form?
Edit: The claim was filed on October 24, and the release form was sent in mid-January.
I’m sorry to hear about the trouble you’re having with the insurance payment. Here are some steps you can consider taking:
Document Everything: Keep a record of all your communications with the insurance company, including dates, times, and the content of your conversations or emails. This documentation may be helpful if you need to escalate the issue.
Follow Up in Writing: If you haven’t already, send a formal written request for payment. Include all relevant details such as your claim number, the date you filed the claim, and a copy of the release form. This creates a paper trail and shows you’re serious about the request.
Contact the State Insurance Commissioner: If the insurance company continues to avoid communication or delays payment, consider filing a complaint with your state’s insurance commissioner. They can intervene on your behalf and may expedite the process.
Legal Assistance: If the situation doesn’t improve, consult with an attorney who specializes in insurance claims. They can review your case and advise you on whether it’s feasible to pursue legal action or if it would be better to involve your own insurance company.
Involve Your Insurance Company: While you mentioned wanting to avoid involving your insurance company, they may have the resources and leverage to help resolve the situation. Since the other party has accepted liability, they may also be able to work on your behalf to ensure you receive the payment.
Consider Small Claims Court: If all else fails, you might consider filing a claim in small claims court for the amount owed. This can sometimes prompt the insurance company to respond more quickly.
Make sure to act quickly, as delays can complicate matters further. Good luck, and I hope you receive the payment you deserve soon!
