Three-car collision hit-and-run… need advice.

Seeking Advice on a Hit-and-Run Involving Multiple Vehicles

I’m looking for advice regarding a complicated multi-vehicle accident in California. About a month ago, I was a passenger in my boyfriend’s car when we were involved in a hit-and-run on the freeway. Two cars (Car 1 and Car 2) were racing each other when Car 1 struck a third, uninvolved vehicle (Car 3), causing Car 3 to hit our car’s right side. After bouncing off us, Car 3 collided with Car 1 again, spun around, and hit our vehicle a second time, ultimately causing us to crash into the freeway wall, about 50 feet behind Car 3. Meanwhile, Car 1 ended up stopped across several lanes, facing the median. Car 2, which hadn’t been involved in the collisions, pulled over near Car 1 as traffic came to a halt. The driver of Car 1 then exited his vehicle, entered Car 2, and fled the scene.

First responders arrived approximately 15 minutes later and collected statements from the drivers of Car 3, my boyfriend, and me. All three vehicles were totaled. Unfortunately, we didn’t get any driver’s license or insurance details, but we do have photos of the license plates from Car 1 and Car 3, as well as a card from the officer who took our statements.

My boyfriend and I have retained a personal injury law firm to represent us. The firm ran the plates on Car 1 and contacted the owner’s insurance company, but they haven’t accepted fault because the owner claims the car was stolen. We’re still waiting for details regarding Car 3’s insurance. My boyfriend has $15k/$30k uninsured motorist (UIM) injury coverage and $3,500 UIM property damage coverage, but no collision coverage. We both sustained minor injuries and incurred some medical expenses. On a side note, he had recently paid off his car, which he purchased used for around $12k. I do have full coverage under my own auto insurance.

Given this situation, are we at a dead end? If the owner of Car 1 is being dishonest, is there any chance they won’t face consequences? I’m uncertain about our options moving forward. Our law firm advised us to hold off on further medical treatment for the time being. Any insights would be appreciated!

  1. I’m sorry to hear about your accident; that sounds incredibly stressful. Here are a few points to consider regarding your situation:

    1. Insurance Investigation: Since the law firm is already involved, they should continue to investigate the accident. It’s not uncommon for insurance companies to initially deny liability, especially in cases involving hit-and-runs or stolen vehicles. Keeping thorough documentation and communication with your firm is crucial.

    2. Uninsured Motorist Coverage (UIM): Since you mentioned you have UIM coverage, this could potentially cover your injuries and property damage if the responsible party is found to be underinsured or uninsured. Discuss with your lawyer how this can be applied in your case, especially since the insurance of the owner of Car 1 is in question.

    3. Car 3 and Liability: It’s also important to pursue claims against Car 3 if they bear any fault in the accident. If they were involved in a collision before hitting your vehicle, their insurance may be liable for some of the damages. Ensure your law firm follows up on this angle as well.

    4. Legal Options: If it turns out that Car 1’s owner is indeed lying about the vehicle being stolen, there may be legal ramifications for them if they are found to be at fault in the accident. It’s worthwhile to let your law firm handle this, as they can navigate the legal process and determine the best course of action.

    5. Medical Expenses: Regarding your medical treatment, it’s generally a good idea to keep all records of your injuries and any treatments, even if your lawyer suggests waiting. If symptoms arise later, documenting them will help substantiate any future claims.

    6. Keeping Communication Open: Continue communicating with your lawyers and keep them updated on any new medical issues or developments regarding the case. They will have the best insight into your options and what next steps to take.

While the situation is complex, it’s good that you’ve engaged a law firm to advocate for you. Trust their expertise and continue to provide them with all necessary information to help build your case. Best of luck with everything!
