Trash Truck Damaged My Gate – Part 2
Well, the trash truck driver damaged our gate, and the repair bill is $3,000 (including parts and labor). We submitted a claim to their auto insurance, but it was denied because the truck isn’t covered for business use.
I reached out to the owner, who claims he has a business policy and will contact them. However, he insists that the driver was just a friend, not an employee, and suggests we pursue him instead?!? That doesn’t seem right—this is not how business liability works. It looks like getting a resolution will be challenging.
The auto adjuster advised us to file a claim through our homeowners insurance and let them handle the subrogation. Just wondering, will this claim impact my insurance record?
It sounds like you’re dealing with a frustrating situation! When it comes to filing a claim on your homeowners insurance, it’s a good idea to check with your insurance agent about how it may impact your policy. Typically, if the claim is settled without fault on your part and your insurer can recover the costs through subrogation, it may not affect your premium. However, every policy is different, so it’s best to get clarification from your insurer.
As for the trash company’s insurance, it’s unfortunate they’re not taking responsibility, especially since that’s generally how liability works in these situations. Filing the homeowners claim might be your best course of action right now, and hopefully, through subrogation, you’ll be able to recover your costs. Just make sure to document everything thoroughly and keep good records of your communications! Good luck!
