Auto Accident Help Needed

I’m reaching out for some advice because I’m really feeling overwhelmed by this situation.

A couple of weeks ago, I was driving my partner’s car (and she was with me) when we got into an accident. Although I’m not listed on the car’s insurance policy, her parents’ policy does allow friends and family to borrow the vehicle. The police came to the scene since it was an accident, but as far as I know, no report was filed and no tickets were issued; we just exchanged information. I was able to drive the car back home, and her parents chose not to file a claim since the car was a 2002 Civic, and the repair costs would exceed the vehicle’s value. The main damage was to the front end, and it seemed like the engine might have been shifted back as well.

However, the other driver has since opened a claim and recently retained an attorney, which has prompted her parents’ auto insurance to also open a claim.

To add to the stress, this accident happened around 2 AM, and there were no traffic cameras in the area. To my knowledge, neither vehicle had a dash cam, and the other driver ran a red light. I was only going about 25-30 mph (the speed limit was 35 mph) because of the rain, and it certainly felt like the other driver was speeding.

Now, I’m anxious about the possibility of being sued and held liable for damages, and honestly, I don’t know what steps to take next. I’m a broke college student, so I don’t have the financial means to cover any damages. Any advice would be greatly appreciated!

  1. It’s completely understandable to feel anxious in this situation—car accidents can be stressful and complicated, especially when there are legal implications involved. Here are some tips you might find helpful:

    1. Stay Calm: Remember that feeling anxious is normal, but try to keep a clear mind. It’s important to take things one step at a time.

    2. Insurance Communication: Encourage your partner’s parents to communicate with their insurance company. They should inform them about the accident and the other driver’s claim. Since the insurance covers drivers, they need to know that you were driving at the time.

    3. Document Everything: Keep a record of all communications related to the accident. This includes any messages or documents from insurance companies, the other driver, or their attorney.

    4. Consult with an Attorney: Since you’re feeling anxious about potential legal action, it may be beneficial to speak with an attorney who specializes in auto accidents. They can provide you with tailored advice and help you understand your rights and responsibilities.

    5. Be Honest: If your partner’s insurance company reaches out for details about the incident, be honest about what happened. Misleading information can create more problems down the line.

    6. Understand Liability: The insurance company will investigate the accident to determine liability. Since the other driver ran a red light, there may be a strong case for their fault in the accident.

    7. Watch for Future Claims: If you do end up receiving any formal notices regarding a lawsuit, don’t ignore them. Respond promptly and consult your attorney.

    8. Mental Health: Remember to take care of your mental health during this process. Consider talking to a counselor or therapist if the anxiety becomes too overwhelming.

It’s understandable to feel worried, but remember that there are resources and people who can help you navigate this ordeal. You’re not alone, and taking proactive steps can help alleviate some of your anxiety.
