Claim filed but never stated damages.

Claim submitted, but no damages have been specified.

Tennessee

Nearly a year ago, in April, I was following a car a bit too closely when they suddenly stopped on the interstate. I lightly tapped their vehicle, but there was no visible damage. While we were pulled over, two other accidents occurred in the area, so we exchanged information and went our separate ways. They’ve filed a claim, but they haven’t specified any damages yet. If we reach the one-year mark without any damages being claimed, will it simply be dropped? My insurance is with State Farm, and I admitted fault while providing them with my dash cam footage.

  1. It sounds like a frustrating situation. In Tennessee, the statute of limitations for filing a claim for damages is generally one year from the date of the accident. If the other party hasn’t filed a claim for damages by that one-year mark, it’s likely that they will not be able to pursue any further action against you for this incident.

However, it’s important to keep in mind that insurance companies often have their internal processes, and it may not be fully out of your hands until that year is up. If State Farm has not communicated any pending claims or damages, it’s a good idea to reach out to them for clarity. They can provide insight into whether any claims have been filed and what your liability may be moving forward. Document your communications and the timeline, just in case you need it in the future.

Ultimately, if you don’t hear anything by the one-year deadline, it’s reasonable to assume you can put this incident behind you. Still, it could be beneficial to stay proactive and informed throughout the process.
