Insurance company is not issuing payment

Title: Delayed Insurance Payment After Truck Damage

I’m dealing with an insurance issue following substantial damage to my building caused by a truck. After a lengthy process, the truck’s insurance company accepted liability and provided a general release of property damage claim for me to sign in order to receive payment. However, it’s now been four weeks since I signed the release, and I still haven’t received any payment. For reference, I have an email stating that the payment was supposed to be issued about two weeks ago.

I’ve attempted to reach out to the at-fault driver’s insurance company multiple times via email and phone, but they have been unresponsive.

I’m looking for advice on my next steps. I was hesitant to involve my own insurance company due to the claim amount (approximately $20,000). Should I consider bringing them in to help expedite the payment or possibly void the release form?

Edit: I filed the claim on October 24th, and the release was submitted in mid-January.

  1. I’m sorry to hear about the difficulties you’re facing with the insurance company regarding your claim. Here are a few steps you might consider taking:

    1. Document Everything: Keep a detailed record of all communications with both insurance companies, including dates, times, and the content of your calls or emails. This will be helpful if you need to escalate the situation.

    2. Follow Up: If you haven’t already, send a follow-up email to the claims adjuster or customer service representative you’ve been dealing with. Be clear and concise about your situation, mentioning the previous timelines they provided regarding payment.

    3. Request a Written Explanation: Ask for a written update on the status of your claim and payment. This puts your request on record and may prompt them to address the issue more promptly.

    4. Contact a Supervisor: If you continue to have trouble reaching someone or getting a response, try to escalate the matter by requesting to speak to a supervisor or manager.

    5. Involve Your Insurance Company: If the above steps don’t yield any results, it may be worth reaching out to your own insurance company. They can advise you on your options and may be able to assist in expediting the payment process or help you understand any implications regarding the release form.

    6. File a Complaint: If necessary, you can file a formal complaint with your state’s insurance department. They can often help you get more attention from the insurance company and enforce proper procedures.

    7. Consult an Attorney: If the situation remains unresolved, you might want to consider consulting with an attorney who specializes in insurance claims. They can help you understand your rights and the best course of action, especially if you might need to void the release form or take legal action.

Remember to stay persistent and patient, as these processes can often take time. Good luck!
