Insurance Payment to New Car Owner?
Back in January, we were rear-ended at a red light and promptly filed a claim with the other driver’s insurance. However, the insurer has been quite unresponsive, and despite our attempts to call them multiple times each week, we only received a response yesterday.
A month after the accident, we relocated to a different state and sold the car. To our surprise, when we finally heard from the insurance company, they indicated that they would be compensating the new owner for the damages, despite the fact that my husband was driving during the incident and we owned the car at that time.
Is this a typical practice? It seems really strange to us!
It’s understandable that you’re feeling confused about the insurance company’s decision. While it may seem unusual, it’s not entirely uncommon for an insurance company to compensate the current owner of the vehicle for damage caused by a previous owner. This can happen if the insurance policy is tied to the car rather than the owner.
In your case, since the accident occurred while you owned the car, you should still be entitled to compensation for the damage, regardless of the car’s current ownership. It might be worth contacting the insurance company again to clarify this situation. You may want to insist on talking to a supervisor or manager to better understand their reasoning and ensure that your rights are protected.
Additionally, consider reaching out to your own insurance company to explain the situation, as they may be able to offer guidance or assistance in getting the matter resolved. It’s important to keep all documentation related to the accident and the claim for your records. Good luck!
